PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to dispose the application filed by the petitioner on 23.01.2023 under Section 5 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 in Notice No.Na.Ka.577/2023/A3. With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
2. The petitioner as a Senior Citizen said to have submitted an application under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 has approached this Court that the first respondent has not conducted an enquiry.
3. The learned Additional Government Pleader appearing for the first respondent, on instructions, submitted that the first respondent has conducted an enquiry on 13.04.2023 and on that day, the petitioner did not appear and therefore, enquiry has not been proceeded further.
4. Considering the rival submissions made, this writ petition is disposed of with a direction to the petitioner to appear before the first respondent along with the copy of this order for the enquiry on 2/4
21.09.2023. On that day, the first respondent shall conduct an enquiry and conclude the proceedings on or before 29.09.2023. No costs. NCC : Yes / No.
