of India, seeking for the issuance of Writ of declaration declaring the action of the respondents in resolving to pay the commuted value of pension payable for the belated payment of the same as illegal, arbitrary and violative of Article 14 and 21 of Constitution of India and consequently directing the respondents to settle the commuted value of pension of the petitioners in one lump sum with interest at the rate of 18% per annum payable from the date of retirement of the petitioners to till the date of payment of the said amount within the time that may be stipulated by this Court.

The learned counsel for the petitioner on record submits that in view of the subsequent developments happened during the pendency of this Writ Petition, this Writ Petition has become infructuous and as such, no further adjudication is required.

3. In the light of the submission made by the learned

counsel for the petitioner, in my considered view, nothing survives in this Writ Petition and it has to be dismissed as infructuous.

4. Accordingly, this Writ Petition is dismissed as infructuous.
