ORDER

This writ petition has been filed for a Mandamus to direct the respondents 1 and 2 to renew his passport on the petitioner's File No.MD1075151201125 dated 09.06.2025 based on his reply dated 24.07.2025.

2. The petitioner is the holder of passport bearing No.N3365998, which was valid from 30.09.2015 to 29.09.2025. He has applied for renewal of the passport. However, the first respondent has declined to renew the passport on the ground that the petitioner is involved in offences under Section 143, 341, 291, 292 of the IPC registered in Crime No.513 of 2024.

3. The learned Government Advocate for the third respondent submits a charge sheet has been filed before the Judicial Magistrate - I, Sivagangai. However, it has not been taken on file.

4. Considering the same, there can be no impediment in directing the first respondent to process the petitioner's passport application.

5. Accordingly, the first respondent is directed to process the passport application of the petitioner and issue passport to the petitioner as expeditiously as possible.

6. It is also made clear that in case charge sheet filed against the petitioner is taken on file, the petitioner shall surrender the passport before the concerned court and retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application. If the petitioner fails to comply with this condition, the first respondent is at liberty to cancel the passport. 7.The writ petition stands disposed of.
