The petitioner herein seeks a direction to the respondents to issue separate patta of the lands comprised in S.Nos. 626/1A (2.80.5 Hec.), 626/2 (0.18.0 Hec.), 626/3 (0.18.0 Hec.) and 626/4 (0.86.0 Hec), situate at Mudhumoththanmozhi Village, Tisayanvilai Taluk, Tirunelveli District, by considering her application dated 19.09.2022.
2. Heard the arguments of Mr.D.Srinivasaragavan, learned counsel for the petitioner and Mr.M.Gangatharan, learned Government Advocate appearing for the respondents.
3. According to the petitioner, she purchased the subject property under a registered sale deed dated 24.06.2022 from M/s.Beach Minerals Company India Limited. Thereafter, she submitted an application before the first respondent on 19.09.2022, seeking issuance of separate patta on the strength of the sale deed. The same has not been considered. Hence, the petitioner has come before this Court.
4. The learned Government Advocate appearing for the 2/4
respondents would submit that the subject property was already declared as surplus land in the hands of the vendor of the petitioner under the provisions of Tamil Nadu Land reforms (Fixation of Ceiling on Land) Act, 1961. In view of the same, there is a difficulty in considering the request of the petitioner.
5. In the light of the stand taken by the respondents, this Court, without expressing any opinion on the merits of the matter, directs the first respondent to consider the application of the petitioner dated 19.09.2022 and pass final orders on its own merits, within a period of six
(6) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
