Resettlement Act, 2013(RFCTLARR Act, 2013) after considering the Petitioner's written representation sent to the second respondent on 24.3.2025, 22.5.2025 and 31.5.2025 to the respondents 1 and 2 and the Tahsildar(LA),SIPCOT, Virudhunagar.

O R D E R

The Writ Petition is filed seeking a direction to the second respondent to refer the dispute regarding fixation of compensation to the Civil Court by considering the Petitioner's written representation, dated 22..5.2025.

2.Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents 1 and 2. By consent of both parties,the Writ Petition is taken up for final disposal at the admission stage itself.

3.It is not in dispute that the property belong to the Petitioner situated at E.Kumaralingapuram, Sattur Taluk, Virudhunagar District with an extent of 0.88.00 hectares was acquired under the provisions of Tamil Nadu Acquisition of Land 2/5

for Industrial Purposes Act,1997. The competent authority had passed an award fixing the compensation payable to the Petitioner in Award No.12 of 2025, dated 30.4.2025. Not satisfied with the compensation by the competent authority, the Petitioner submitted a representation before the second respondent on 22.5.2025 seeking reference to the Civil Court for enhancement of compensation. The same has not been considered so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra.

4.It is seen from the typed set of papers that the Petitioner has submitted his objection relating to quantum of compensation and sought for reference within the time limit of 60 days as per Section 8 of Tamil Nadu Acquisition of Land for Industrial Purposes Act,1997. Therefore the second respondent is bound to consider the same and pass appropriate orders for referring the matter to the Civil Court.

5.Accordingly, the second respondent is directed to consider the representation of the Petitioner, dated 22.5.2025 and pass final orders for referring the matter to the competent Civil Court within a period of six weeks from the date of a copy of this order.

6.With the above directions, the Writ Petition stands disposed of. No costs.
