ORDER

Heard the learned counsel appearing for the revision petitioner. Issuance of notice to the respondents is dispensed with.

2. The only request made by the petitioner is for directing the court below to number the petition mentioned IA. It appears that M.C.O.P.No.36 of 2010 on the file of the Chief Judicial Magistrate, Theni was dismissed for non prosecution and that IA was filed for restoring the same. Since there was delay in filing the restoration petition, another IA was filed for condoning the delay. IA for condoning the delay is allowed on payment of cost. Cost was not paid in time. That led to dismissal of IA. Seeking extension of time for payment of cost, another IA has been filed. The grievance of the petitioner is that it has not been numbered till date.

3. The court below shall number the petition mentioned IA and give disposal on merits and in accordance with law within a period of ten weeks thereafter. The Civil Revision Petition is disposed of accordingly. No costs. 17.10.2024 NCC : Yes / No Index : Yes / No Internet : Yes / No rmi 2/4
