ORDER
(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed by the father of the detenu to produce his son, who is said to be missing from 29.08.2022 onwards. 2.When the matter came up for hearing on 01.11.2022, this Court passed the following order:
"Mr.A.Thiruvadi Kumar, learned Additional Public Prosecutor takes notice on behalf of the respondents.
2. The father has filed this petition to produce the body of his missing son, named Rakul, who is aged about 19 years.
3. The learned Additional Public Prosecutor, on instructions, submitted that a man missing FIR has already been registered in Crime No.225 of 2022 and sought for some more time. He further submitted that all efforts are being taken to find the whereabouts of the detenu and already six witnesses have been examined.
4. Post this Habeas Corpus Petition on 18.11.2022." 2/5
3.When the matter was taken up for hearing today, the learned Additional Public Prosecutor produced the Case Diary. On going through the same, it is seen that the whereabouts of the detenu has been ascertained at Trivandrum and accordingly, all steps have been taken to affix notices and photos of the detenu in order to find out the detenu and to secure him. 4.In the considered view of this Court, since the respondent police are taking effective steps to find the whereabouts of the detenu, it will suffice if a direction is issued to the second respondent to comply with the guidelines given in Selvaraj v. State rep. by the Superintendent of Police and others reported in (2018) 3 MLJ (Crl) 712 to secure the detenu at the earliest possible time.
