O R D E R
The Writ Petition is filed seeking a direction to the respondents 1 to 3 to consider the Petitioner's representation, dated 23.7.2025 and consequently direct the third respondent to delete the inclusion of the Petitioner's property to an extent of 1 acre 77 cents in S.NO.401/2A at Kullappa Goundapatti Village, Keelakudalur East Revenue Village, Uthamapalayam Taluk, Theni District from the Kallar Jari Register of the third respondent within the time stipulated by this Court.
2.Mr.M.Gangatharan, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties,the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the Petitioner, he purchased the subject property from one Rita Arockiya Mary under sale deed, dated 26.10.2012, who in turn had purchased the property from one Jamuna under sale deed, dated 6.4.1993. When the Petitioner 2/5
submitted an application before the Zonal Deputy Registrar, Uthamapalayam Taluk, the application was rejected on 29.10.2024 on the ground that the subject property was classified as Kallar Jari. Therefore, the Petitioner submitted a representation, dated 23.7.2025 before the third respondent seeking to set aside the order passed by the Zonal Deputy Tahsildar and to issue patta in his name after deleting the property from Kallar Jari Register maintained by the Revenue Department. The same has not been considered so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra. 4.Mr.M.
Gangatharan, learned Government Advocate, who takes notice for the respondents 1 to 3 would submit that the representation submitted by the petitioner will be considered in accordance with law, within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the representation submitted by the Petitioner, dated 23.7.2025 and pass final orders on its own merits after affording reasonable opportunity to the Petitioner and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order.
6.With the above directions, the Writ Petition stands disposed of. No costs.
