ORDER

Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor for the first respondent submitted that in this case, investigation completed and charge sheet also filed as early as on 21.02.2023 before the Judicial Magistrate Court No.II, Virudhunagar, and the same has been taken on file as C.C.No.113 of 2023.

2. In view of the above said submission, the learned counsel for the petitioner seeks permission of this Court to withdraw the Criminal Original Petition with liberty to file a fresh Criminal Original Petition to challenge C.C.No.113 of 2023 and he also made an endorsement to that effect.

3. Recording the abovesaid submissions and the endorsement made, this Criminal Original Petition is dismissed as withdrawn with liberty as prayed for. Consequently, connected Miscellaneous Petition is closed. 28.07.2023 Index : Yes/No Internet: Yes/No 2/4
