Prayer in CRL MP(MD) No.11744/2021 :
Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to extend the time imposed in Crl.O.P. (MD) No. 18190 of 2021 order dated. 22.11.2021 and permit the petitioner to surrender and execute sureties before the learned Judicial Magistrate, Aruppukottai, Virudhunagar District.
Order : These petitions coming up for orders on this day, upon perusing the petitions filed in support thereof and upon hearing the arguments of Mr.SIVABALAN.K., Advocate for the petitioner in both petitions and of Mr.M.VAIKKAM KARUNANITHI, GOVT. ADVOCATE (CRIMINAL SIDE)on behalf of the Respondent in both petitions the court made the following order:- These petition have been filed to modify the condition imposed upon the petitioners by order dated in Crl.O.P.(MD).No.18190 of 2021 dated 22.11.2021 and to extend the time imposed in the above said order to surrender before the concerned Court. https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.M.P.(MD)Nos.11742 & 11744 of 2021 2.The grievance of the petitioner is that if the petitioners are directed to appear before the learned Judicial Magistrate, Aruppukottai, they will face trouble at the hands of defacto complainant. On that ground this petition has been filed and he would state that the petitioners are ready to surrender before any Court in Virudhunagar District, other than Aruppukottai. 3.Since the file has been transferred to the concerned Court, such relief may not be possible. Hence, the condition imposed upon the petitioners is modified to the effect that 'the petitioners are ordered to be released on bail in the event of arrest or on their appearance, before the respondent police, on condition that the petitioners shall execute a bond for a sum of Rs.
10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the respondent police is concerned'. The time for surrender and execution of sureties before the respondent police is also extended for the period of fifteen days from the date of receipt of a copy of this order.
4.Accordingly, these criminal miscellaneous petitions are ordered.
