Mr.R.Sureshkumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 247 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who is apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 323, 324, 427, 448, 506(ii) IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002, in Crime No.247 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that because of bad antecedents of the petitioner, the defacto complainant's paternal uncle refused for marriage of her 1/3
daughter with the petitioner. Due to that motive, on 16.12.2022 at about 5.30 a.m., the accused abused the defacto complainant in filthy language and also attacked him using wooden log. Thereafter, at about 6.30 p.m., on the same day, the petitioner threatened the family members of defacto complainant's uncle and also attacked them using knife. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person. It is love affair between the petitioner and one Priya, who is relative of the defacto complainant, over which, the above said occurrence said to have taken place.
4. Reading of the First Information Report shows that because of bad antecedents of the petitioner, the above said marriage proposal is not accepted by the defacto complainant's party.
5. Considering the facts and circumstances of this case and also considering the conduct of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
