O R D E R
This petition is filed for a direction to direct the respondent for not to harass the petitioner and his family members in the name of enquiry by considering his representation dated 24.10.2019 in accordance with law.
2.When the matter was taken up for hearing on 06.11.2019, a representation was made that the the learned counsel appearing for the petitioner was held up before the other Court, accordingly, the case is posted today. Even today, Mr.Manoj, learned counsel, who represented the counsel on record sought further time. 3.The learned Additional Public Prosecutor appearing for the respondent/CBI on instructions, would submit that the petitioner is an accused in FIR/Case No. RC 11(A)/2019 pending on the file of the respondent police and the same was registered on 14.06.2019. According to the respondent, the petitioner has obtained loan of Rs.40,00,000/- from the Lakshmi Villas Bank, Rajapalayam Branch, Virudhunagar District by pledging 3,200 paddy bags under the NBHC PVT LTD at Rajapalayam and on verification it was found 900 bags of https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD) No.15971 of 2019 paddy alone is available in the NBHC godown. According to the learned Additional Public Prosecutor, apart from this petitioner, the bank officials as well as the employees of National Bulk Handling Corporation are also arrayed as accused. He further submits that the investigation in this case is in the crucial stage and the petitioner is not cooperating the investigation. 4.Recording the submission made on behalf of the respondent, this criminal original petition is dismissed. It is open to the respondent police to secure the accused and proceed with the investigation, if the petitioner is not cooperating for the investigation.
