ORDER : The Court made the following order :- The petitioner/Accused No.3, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 324, 506 (ii) of IPC, in Crime No.320 of 2023 on the file of the respondent police, seeks 1/3

anticipatory bail.

2.The case of the prosecution is that there is a matrimonial dispute between the defacto complainant and the wife, who is the first accused herein. On 20.08.2023 at about 11.00 a.m., when he went to see his wife, his wife/A1 abused him in filthy language and also called her sister A2, she in turn called her husband A3, this petitioner. This petitioner attacked the defacto complainant with Manvetti kanai and made life threat upon him. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. 4.The learned Government Advocate (Crl. Side) appearing for the State would submit that the injured in this case is still in hospital as inpatient and taking treatment. Hence, he opposed the grant of anticipatory bail to the petitioner. 5.

Considering the grievous nature of injury and the injured is still in hospital, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this criminal original petition stands dismissed. sd/- 12/09/2023 / TRUE COPY / /10/2023 Sub-Assistant Registrar (C.S.)
