RESPONDENT/COMPLAINANT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition to appear before the respondent daily at 10.30.a.m. until further orders imposed upon the petitioners in order Crl.O.P.(MD)No.12149 of 2023 dated Honble 20.07.2023 by this Court.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KANNAN.N, Advocate for the petitioner and of Mr.M.SAKTHI KUMAR, Government Advocate (crl.side) on behalf of the Respondents the court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the condition imposed on the petitioners in Crl.O.P(MD) No.12149 of 2023 dated 20.07.2023
2. According to the petitioners they are complying with the condition from 11.08.2023, hence seek relaxation of the said condition. 1/3

The learned Government Advocate(Crl.Side) appearing for the respondent also admitted that the petitioners are complying with the conditions till 12.09.2023 and thereafter they failed to comply with the conditions from 13.09.203 to 15.09.2023. He further submitted that the petitioners have complied the conditions from 16.09.2023 to till date.
4. The learned counsel appearing for the petitioners submitted that they went to hospital for treatment and hence they are unable to comply with the conditions. 5.Considering the representation made by the learned counsel appearing for the petitioners and the learned Government Advocate(Crl.Side) and considering the fact that the petitioners are complying the conditions from 11.08.2023 and considering the nature of offence and considering the reason stated by the learned counsel for the petitioners in the affidavit for not complying the conditions from 13.09.2023 to 15.09.2023, this Court is inclined to relax the condition.
