ORDER
This Transfer Petition is at the instance of wife. She seeks withdrawal of I.D.O.P.No.910 of 2025 from the file of Family Court, Madurai and transfer the same to the file of Family Court, Tirunelveli.
2. Heard Mr.S.Suresh Manickam, learned counsel for petitioner, M/s.K.Vidya, learned Counsel for respondent and this Court carefully perused the materials available on record.
3. The petitioner and respondent got married on 19.06.2024 at C.S.I.Good Shephered Church at Rahmath Nagar, Palayamkottai as per Christian rites and customs. Due to differences, parties have separated. The respondent/husband initiated proceedings in I.D.O.P.No.910 of 2025 for dissolution of marriage before the Family Court, Madurai. The petitioner has also filed a petition in D.O.P.No.259 of 2025 before the Family Court, Tirunelveli, for dissolution of marriage.
4. This Court vide order dated 31.10.2025, referred the matter to mediation. In compliance with the said order, both parties appeared before the Mediator. Today, when the matter was taken up for hearing, learned 2/5
counsel for both sides submitted that the matter has been amicably settled through mediation, and accordingly, a settlement agreement was entered into between the parties on 17.12.2025. Relevant portion of settlement agreement reads as follows:
''a) The petitioner herein agrees to grant the prayer sought by the respondent/husband in IDOP.No.910 of 2025 on the file of the Family court, Madurai.
b) Both parties agree to dissolve their marriage solemnized on 19.06.2024 at C.S.I.Good Shepherd Church at Rahmath Nagar, Palayamkottai, Tirunelveli.
c) Both the parties agree that they will not claim any maintenance from each other. Under any circumstances. d) The petitioner/wife already took the sridhana articles, dress materials and other belongings from the house of the respondent/husband.
e) Both the parties agree that there shall not be any mutual claims between them hereafter subject to the fulfilment of the terms as mentioned above.
f) Both the parties agreed to appear before the Hon'ble Court on the hearing date and to file Affidavit/Petition if so directed by the Court.''

In these circumstances, this Court is of the view that it is open to the learned counsel for the petitioner and the respondent to seek a decree of divorce before the Family Court, Madurai, based on the settlement agreement dated 17.12.2025 entered into between the parties. The settlement agreement dated 17.12.2025 shall form part and parcel of this order.
6. With the above directions, this Transfer Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 20.01.2026 Index:Yes/No Speaking Order :Yes/No gvn To 1.The Judge, Family Court, Madurai.
