PRAYER :- For Bail in Crime No.102 of 2022 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/sole Accused, who was arrested on 22.08.2023 for the alleged offence under Sections 379 of IPC r/w Section 21(1) of Mines & Minerals 1/3

(Development & Regulation) Act, 1957, in Crime No.102 of 2022 on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that on 27.01.2022, on receipt of information, the respondent Police conducted raid at Kollidam river bed, Olugacheri, at that time, the respondent Police intercepted, checked the vehicle and also they found that the petitioner has transported four bags of river sand in his two wheeler. Therefore, the present case came to be registered.

3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in judicial custody from 22.08.2023. 4.The learned Additional Public Prosecutor appearing for the respondent police submitted that there is no previous case pending against the petitioner. 5.Considering the facts and circumstances of this case, no previous case is pending against the petitioner and considering the duration of custody, this Court is inclined to grant bail to the petitioner with certain conditions; 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruvidaimaruthur, and on further condition that 2/3

the petitioner shall report before the respondent Police daily at 10.30 a.m. until further orders.
