ORDER

This Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders to direct the second respondent police to expedite the investigation in Crime No.11 of 2018 dated 08.06.2018 and file the final report within a stipulated time as may be fixed by this Court.

When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondents would submit that the second respondent, after completing the investigation, has filed a final report on 09.03.2024 through e-filing before the Judicial Magistrate, Papanasam.

3. The learned counsel appearing for the petitioner would submit that the petitioner has applied for certified copies of the charge sheet and the statements filed along with the charge sheet on 21.09.2024 and the learned Magistrate has returned the same on 24.09.2024 stating that charge sheet has not been filed so far.

4. Considering the above, in case of issuance of any memo to 2/4

rectify the defects in the charge sheet, issued by the learned Magistrate, the second respondent is directed to rectify the defects and re-submit the same within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the learned Judicial Magistrate, Papanasam is directed to take the charge sheet on file, if it is otherwise in order within a period of one week thereafter.

5. With the above direction, this Criminal Original Petition stands disposed of.
