ORDER

The present writ petition has been filed seeking a mandamus as against the respondents 1 and 2 herein to incorporate the name of Sivagami Poornakirubeswaran in the place in Premalatha in the birth certificate and issue a fresh birth certificate.

2. The petitioner herein was initially issued with a birth certificate under the name and style of Premalatha. The said certificate was issued on 29.06.2021. The petitioner has changed her name from Premalatha to P.Sivagami by way of a Gazette publication dated 27.12.1999. 2/6

3. Again the petitioner has changed her name from P.Sivagami to Sivagami Poornakirubeswaran by way of Gazette Publication dated 24.02.2025. The passport of the petitioner reflects the name as Sivagami Poornakirubeswaran. Therefore, the petitioner has approached this Court seeking a direction as against both the respondents to issue fresh birth certificate incorporating the petitioner's daughter's name as Sivagami Poornakirubeswaran.

4. The learned counsel appearing for the petitioner submits that there is a spelling mistake in the birth certificate, i.e., her father name is spelled as Pooranakribeswaran, however, the correct name is Poornakirubeswaram.

5. The learned Standing Counsel appearing for the 1st respondent submits that the petitioner is often changing her name by way of Gazette Publication and therefore, it is very difficult to issue a fresh birth certificate.

6. That apart, the petitioner has not approached the authorities within the time frame fixed under the rules for alternate name.

Considering the fact that the petitioner's passport stands in the name of Sivagami Poornakirubeswaran, in order to avoid any dispute, the respondents herein are directed to issue a fresh birth certificate incorporating the name of the petitioner as Sivagami Poornakirubeswaran and further directed to change the petitioner's father's name as Poornakirubeswaram in the place of Pooranakribeswaran. The said exercise shall be completed within a period of 6 weeks from the date of receipt of a copy of this order.

8. With the above deliberations, the writ petition stands allowed. No costs.
