ORDER : The Court made the following order :- The petitioner/Accused No.2, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC (Sand)in Crime 1/3

No.184 of 2023, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 06.09.2023, at about 10.00 a.m., when the respondent police were on routine patrol duty, they found a tipper lorry in the agricultural land, which transporting 3 units of gravel stones worth about Rs.3,000/- illegally. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. 4.The learned Government Advocate (Crl. Side) for the respondent police submitted that the petitioner is having one previous case, which is similar in nature. 5.On the ground that the petitioner was taking the above said stones for the purpose of blocking the water leakage, this petition has been filed. On that ground, the respondent was directed to be present before this Court. Today, the respondent police is present before this Court and has stated that the above said stones have been taken from Nedunkulam Kanmai area. Apart from that, he has also submitted that the petitioner is having one previous case, which is similar in nature registered in the year 2018.

6.In view of the submissions made by the respondent police, absolutely, I find no reason to entertain this petition. The petitioner is not entitled for any relief from this Court at this stage.
