ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.LENIN KUMAR, Advocate for the petitioner and of Mr.VAIKKAM KARUNANIDHI, Government Advocate on behalf of the 1st Respondent and Mr.V.

BALAJI, Advocate for the 2nd Respondent, the court made the following order:- The petitioner has moved this application to cancel the anticipatory bail granted to the second respondent / accused by this Court in Crl.OP(MD)No.20299 of 2021, dated 22.03.2022. According to the petitioner's Counsel, this Court, by recording the undertaking given by the second respondent / accused that he would settle the entire amount of Rs.55,00,000/-, granted anticipatory bail to the accused. Alleging that the accused failed to honour the undertaking given before this Court, the petitioner has moved this instant application.

2.Learned Counsel for the second respondent / accused submitted that so far he has settled a sum of Rs.17,00,000/- and that the balance amount would be settled soon. He further submitted that in Crl.OP(MD)No.20299 of 2021, the second respondent / accused gave an undertaking that he would settle the amount within 18 months period and the said time period is yet to be completed. https://www.mhc.tn.gov.in/judis 1/2

Crl.MP(MD)No.13530 of 2022 3.In view of the above submission made by the second respondent / accused, this criminal miscellaneous petition stands closed, with liberty to the petitioner to revive this application after the expiry of the 18 months period specified in Crl.OP(MD)No.20299 of 2021, dated 22.03.2022.
