ORDER : The Court made the following order :- The petitioners/A2 & A3, who was arrested and remanded to judicial custody on 31.08.2024 for the offences under Sections 8(c) and 20(b)(ii)(B) of Narcotic Drugs 1/3

and Psychotropic Substances Act, 1985 in Crime No.380 of 2024, on the file of the respondent police, seek bail.

2.The case of the prosecution is that the petitioners were found in illegal possession of 1.900kgs of Ganja.

3.Heard. Perused the materials available on record including the First Information Report.

4.As far as the first petitioner/A2 is concerned, the learned Additional Public Prosecutor reports that he has been detained under Act 14 of 1982. As such, this petition is dismissed in respect of the first petitioner/A2. 5.As far as the second petitioner/A3 is concerned, considering the case that 1.900kgs of Ganja is recovered in the present case and the petitioner is arrested only on 31.08.2024 and that he has got four previous cases, out of which, two under NDPS Act cases, for the present I am not inclined to enlarge the second petitioner on bail. Hence, this petition is dismissed.
