Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to issue direction to transfer the investigation in Crime No.15 of 2025 pending investigation on the file of the 2nd respondent police to some other independent investigating agency under the supervision of the 1st respondent. ORDER

The petitioner has sought for transfer of investigation in Crime No.15 of 2025 on the file of the second respondent to some other investigating agency under the supervision of the first respondent, making allegations of inaction and lethargy on the side of the second respondent.

2. The learned Additional Public Prosecutor, on instructions, would submit that the second respondent had conducted investigation in an effective manner and had closed the complaint as 'mistake of fact' and the Referred Charge Sheet notice has also been sent to the petitioner.

3. In view of the said submission, there cannot be any direction for transfer of investigation at this stage. However, the petitioner is at liberty to challenge the closure report in the manner known to law.

4. With the above observations, this Criminal Original Petition stands closed.
