PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 2 to 4 to pass orders on the representation of the petitioner dated 30/09/2019 and direct to conduct the proper enquiry by issuing the notice to respondents 5 to 7 and the undersigned applicant herein willing to produce all relevant documents before the authority concerned with respect to S.F.No.353/2 of Kollanchi village, Vilavancode Taluk, Kanyakumari District and further direct the authority to cancel the Patta No.15011 issued in favour the deceased Mr.Varuvel and restore the Joint Patta No.6188 as its original position according to the Revenue Standing orders and Patta Pass Book Act.

ORDER

This writ petition has been filed for issuance of writ of mandamus, directing the respondents 2 to 4 to consider the representation made by the petitioner on 30.09.2019, wherein the petitioner has sought for cancellation of the order granted in favour of the 7th respondent with respect to the subject property.

2. Heard Mr.K.Vadivelu, learned counsel appearing for the petitioner and Mr.A.K.Manikkam, learned Special Government Pleader appearing for the official respondents.

Taking into consideration the facts and circumstances of the case, the limited relief sought for in this writ petition and without going into the merits of the matter, the petitioner is also directed to make a fresh representation to the third respondent along with all relevant documents and also a copy of this order, who in turn, shall consider and pass orders on the representation made by the petitioner by putting on notice all the interested parties and by affording them an opportunity, on its own merits and in accordance with law, within a period of three months from the date of receipt of representation from the petitioner.
