Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents herein to settle the cash benefits to the petitioner on surrender of his earned leave to the tune of 240 days and unearned leave to the tune of 180 days with 18% interest by issuing a revised order of retirement deleting the rider clause.

This writ petition has been filed for a direction to the respondents to settle the benefits to the petitioner on surrender of his earned leave for 240 days and unearned leave for 180 days with 18% interest.

2. The learned counsel appearing for the petitioner would submit that the petitioner was retired from service on 31.08.2012 and he is eligible to get terminal benefits such as gratuity, encashment of surrender of earned and unearned leave. However, the respondents have settled the gratuity amount only on 11.12.2014. Hence, the petitioner has made a representation to the respondents, on 10.08.2016. But, till date no order was passed. Therefore, this Court may issue a direction to the respondents to dispose of the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.21280 of 2016 representation of the petitioner, dated 20.10.2016, on merits and in accordance with law, within a specified period.

3. The learned Standing Counsel appearing for the respondents has no serious objection for such an order being passed by this Court.

4. Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the matter, directs the respondents to consider the petitioner's representation, dated 20.10.2016 and pass orders, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
