Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 1 to 3 to give police protection to secure the petitioner's life and his property in S.F.No.104 with an extent of 12 Acre 42 cents situated at Thirumalaiyanpatti, Saampatti Village, Manapparai Taluk, Trichy District against the illegal activities of the 4th respondent and his men and agents based on the petitioner's representation dated 02.12.2021.

ORDER

Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 to 3. 2.The petitioner wants this Court to direct the respondent police to give him police protection in respect of the petition mentioned property.

W.P(MD)No.22664 of 2021 3.It is seen that the petitioner has already filed O.S.No.193 of 2021 before Sub Court, Manapparai in this regard against the fourth respondent herein. The petitioner has to necessarily pursue the said civil remedy. When the petitioner is not having any enforceable order or decree from the jurisdictional civil Court, the question of granting police protection in writ proceeding does not arise.

4.Leaving open the other remedies and rights of the petitioner, this writ petition is dismissed. No costs.
