BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 08.08.2024

CORAM:

THE HONOURABLE MS.JUSTICE P.T.ASHA Perummalamal .. Petitioner Vs.

1.The Tahsildar, Aandipatti Taluk, Theni District.

2.The Taluk Surveyor, Andipatti Taluk, Theni District.

.. Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondent to survey the four boundaries of the petitioner's vacant land in S.No.95/2B at Marikundu Village, M.Subbalapuram, Aandipatti Taluk, Theni District. For Petitioner :

No appearance For Respondents :

Mr.D.S.Neduchezhiyan Government Advocate

ORDER

Learned counsel for the petitioner is not present. Heard the learned Government Advocate for the respondents.

2. Perusal of the affidavit would indicate that on two occasions, the respondents have surveyed the lands of the petitioner. The second survey was done pursuant to the representation of the petitioner dated 10.12.2015. The petitioner has now filed this writ petition for a mandamus directing the respondent to once again survey the four boundaries of her property situate in S.No.95/2B at Marikundu Village, M.Subbalapuram, Aandipatti Taluk, Theni District.

3. The only reason given for seeking a re-survey is that the "petitioner is not satisfied with the earlier survey". How the petitioner is not satisfied and how he finds fault with the survey that has already been done on two occasions are not set out. Therefore, this Court is not inclined to issue a mandamus to the respondent.

4. For the above reasons, this Writ Petition is dismissed. However, there shall be no order as to costs.
