PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to permit the petitioner to conduct Aadal Padal Cultural program on 25.10.2022 from 7.00 pm to 12.00 pm during the temple 1/4

festival of Sri Raja Rajeswari Amman Temple, Thevar Nagar, Kadaladi Taluk, Ramanathapuram District.

O R D E R

This Writ Petition has been filed to direct the Respondents to permit the Petitioner to conduct the cultural program, Aadal Padal, on 25.10.2022 from 7.00 pm to 12.00 pm in connection with the temple festival of Sri Raja Rajeswari Amman Temple, Thevar Nagar, Kadaladi Taluk, Ramanathapuram District.

2.The learned Government Advocate for the Respondents submit that the entire Ramanathapuram District is under promulgation of Section 144 Cr.P.C. from 07.09.2022 to 31.10.2022. Therefore, the Respondents 2 to 4 are unable to consider the representation of the Petitioner for the date prior to 31.10.2022. He also vehemently objects stating that there is a possibility of law and order issue. The Petitioner had not impleaded the District Collector, Ramanathapuram District.

3.On the submission of the learned Government Advocate regarding promulgation of Section 144 Cr.P.C in the entire Ramanathapuram District, this Court suo motu impleads the District Collector, Ramanathapuram District as the first Respondent in this case. The Respondents 1 to 3, who are the parties already, are to be considered as Respondents 2 to 4.

4.In the light of the vehement objection of the learned Government Advocate, the second Respondent/the Superintendent of Police, Ramanathapuram District in consultation with the first Respondent/the District Collector, Ramanathapuram District, shall pass appropriate orders on merits and in accordance with law, by considering the representation of the Petitioner dated 11.10.2022 on or before 24.10.2022.

5.With the above direction, this Writ Petition stands disposed of. No costs.
