The Criminal Miscellaneous Petition has been filed seeking orders to condone the delay of 94 days in filing the Criminal Appeal challenging the judgment of conviction made in Spl.S.C. No.84 of 2023 on the file of the learned Special Court for Trial of POCSO Act Cases, Theni, dated 25.02.2025.

2.Despite receipt of notice, the defacto complainant has not turned up.

3.Heard the learned counsel for the petitioner as well as the learned Government Advocate (Criminal Side) and also perused the records.

4. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 94 days in filing the Criminal Appeal, is condoned and accordingly, this petition is allowed. Registry is directed to number the appeal, if it is otherwise in order.
