PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the second respondent herein to issue Hindu - ST Kattunayakkan Community Certificate to the petitioner's school going children namely M.Rohith and M.Ritish, within a time stipulated by this Court.

[Order of the Court was made by S.S.SUNDAR, J.] Mr.J.Ashok, learned Additional Government Pleader, takes notice for the respondents.

2. With the consent of both sides, this writ petition is taken up for final hearing at the admission stage itself.

3. This writ petition is filed for issuance of a writ of mandamus directing the second respondent to issue Hindu - ST Kattunayakkan Community Certificate to the petitioner's school going children, namely, M.Rohith and M.Ritish, within a time stipulated by this Court.

4. Though the petitioner seeks a positive direction, learned counsel for the petitioner states that the petitioner would be satisfied if a direction is issued to the second respondent to consider the application submitted by him online for issuance of community certificate to his children within a time stipulated by this Court.

5. Having regard to the above submission of the learned counsel for the petitioner, without expressing any opinion on the merits of the matter or the averments in the affidavit filed in support of this writ petition, the second respondent is directed to consider the petitioner's application said to have been submitted by him online for issuance of community certificate to his children and pass appropriate orders on merits and in accordance with law, after holding a proper enquiry, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs.
