ORDER

By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

2. The writ petition has been filed for a mandamus directing the respondent to accept the registration of the sale deed dated 20.09.2024 executed by Dinesh Ayyappan in respect of property in Survey No. 231/5B, Plot No. 25, an extent of 2100 Sq. feet in Keelakurichi village, Thiruverumbur Taluk, Trichy District as per the Online Application No.TP/ 195300179/2024 dated 19.09.2024 without probing the title of the property, within the period stipulated by this Court.

3. According to the petitioner, the petitioner presented a sale deed based on the unregistered Will executed by the aunt of the vendor of the petitioner. It is his case that the property initially was owned by the aunt of the vendor of the petitioner, who, through the unregistered Will has settled the property in favour of her sister's son/nephew from whom the petitioner has purchased the property. However, as the Will is an unregistered one, the sale deed has not been accepted. 2/4

4. The learned Additional Government Pleader, on instructions, would submit that no document is presented for registration and if the document is presented, the same shall be registered as per law.

5. I have considered the rival submissions and perused the materials available on record.

6. In such view of the matter, on the petitioner presenting the document, the same shall be registered as per law, if the same is otherwise in order.

7. The writ petition is disposed of with the above direction. No costs.
