ORDER

The petitioner / de facto complainant in Crime No.133 of 2025 on the file of the Kallikudi Police Station, Madurai has filed this petition seeking a direction to the respondent police to file the final report in Crime No.133 of 2025 registered on 18.07.2025, within a stipulated time.

2.The learned counsel for the petitioner submits that the petitioner's complaint has been registered in Crime No.133 of 2025 on 18.07.2025 for the offence under Sections 294(b), 120(b), 467, 415, 416 and 506(i) of IPC. The case of the petitioner is that a forged power of attorney has been executed in favour of one Subburaj, 1st accused on 14.08.2007 and with the forged power of attorney, the 1st accused has executed a sale deed in favour of 2nd accused. According to him, the subsequent sale deed is a forged one and the petitioner has come to know about the same only through the encumbrance certificate and thereafter he has lodged this complaint. 2/5

3.The petitioner has lodged this complaint for the incident took place in the year 2007. The case was registered on 18.07.2025. The statutory time has been prescribed to the police officers to conclude the investigation of this nature of offence. Even before the expiry of the statutory period, the petitioner has filed this petition in a casual manner, resulting the Government to spend not less than Rs.10,000/- to the Government exchequer. The government is spending Rs.4,500/- for disposal of a case for the Government Advocate representing the case. For providing instructions to the Government Advocate, the Sub Inspector of Police attached to the police station is visiting the Government Pleader's officer and he is provided with travelling allowance and other allowances. 4.Considering the manner in which this petition has been filed even before the expiry of the statutory period of filing the final report and for making the government to incur expenditure, this court is inclined to dismiss this petition with cost. 3/5

5.Accordingly, this petition is dismissed with cost of Rs.5,000/- (Rupees Five Thousand), which shall be paid for the welfare of the study centre maintained by the Madurai Corporation [Account No.110197467504 A/c.Name: Commissioner Madurai Corporation, Canara Bank, Arignar Anna Malaigai, Madurai], within a period three weeks from the date of receipt of a copy of this order. 26.08.2025 DSK To 1.The Inspector of Police, Kallikudi Police Station, Madurai.
