PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 5th respondent herein to take action on the directions issued by the 4th respondent vide proceedings in Ku.Pa.No. 4/1997, dated 10.07.2000 pertaining to petitioner's above described 3 acres (1.21.0 hec) of land, having Patta No.143, comprised in Survey No.410/1 (out of total extent of 12.12.0 hec land), situate in Muthazhvarpatti Village, Marungapuri Taluk, Thiruchirapalli District, and issue computer receipt for the payment of lease amount in correct survey number of the land being 410/1 within a time limit.

ORDER
In view of the order proposed to be passed, the Joint Commissioner, Hindu Religious and Charitable Endowment Department, Trichy, is substituted as 5th respondent in place of the Executive Officer, Arulmigu Veeramakaliyamman Temple, Thottipatty, Amman Kovil Street, Thottipatty - 621 305, Marungapuri Taluk, Thiruchirapalli District, who was originally arrayed as 5th respondent.

2.Heard the Party-in-person, namely, Mr.V.Palanisamy, who appeared in person along with the learned Additional Government Pleader for the respondents.
3.The petitioner has obtained an order from the 4th respondent on 10.07.2000, whereby the 4th respondent recognised the petitioner as a cultivating tenant. However, the petitioner claimed that the petitioner has not got the benefits and therefore, the petitioner seeks for a mandamus to the 5th respondent to issue a computer receipt for the payment of lease amount in correct Survey Number of the land in S.No.410/1, within the stipulated time prescribed by this Court.
4.The learned Additional Government Pleader appearing for the official respondents would submit that no Executive Officer has been appointed for the 5th respondent Temple. It is submitted that only the Joint Commissioner, Hindu Religious and Charitable Endowment Department is competent to decide whether the petitioner has to be given lease hold rights in respect of the subject land measuring to an extend of 3 acres wherein the Patta No.143, in S.No.410/1. Since the petitioner is a senior citizen, this Court is inclined to substitute the 3/6
name of the 5th respondent as the Joint Commissioner, Hindu Religious and Charitable Endowment Department, Trichy. The 5th respondent/Joint Commissioner, Hindu Religious and Charitable Endowment Department, Trichy, is directed to consider the request of the petitioner for issuance of the computer receipt for the payment of the lease amount. Since no representation is available, the petitioner is directed to give a fresh representation to the 5th respondent who shall consider the same and pass appropriate orders within a period of 3(three) months from the date of receipt of a copy of this order. 5.Accordingly, this Writ Petition stands disposed of.
