Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the respondents to comply with the order passed by the learned Judicial Magistrate, No.1, Madurai in Cr.M.P.No.4282 of 2024, dated 30.01.2025, consequently direct the respondent police to register the case as against the proposed accused.

The petitioner has lodged a complaint before the learned Judicial Magistrate No.1, Madurai and the same has been forwarded to the respondent police for necessary action. The petitioner with a grievance that though there is a direction from the learned Magistrate, the respondent police has not conducted any enquiry on his complaint and therefore he has filled this application seeking a direction to the respondent police to comply with the order of the learned Magistrate.
2. Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the respondents 1 & 2 submits that the complaint of this petitioner has been forwarded by the learned Judicial Magistrate NO.I, Madurai, in Cr.MP No.4282 of 2024, dated 30.01.2025. They have conducted a preliminary enquiry, they found that the complaint of this petitioner has not made out any criminal offence and therefore they have filed a report before the learned Judicial Magistrate. A copy of the report is also placed before this Court.

3. Recording the aforesaid submissions of the learned Government Advocate(Crl.side), this Criminal Original Petition is closed with a direction to the respondent police to furnish a copy of the closure report to the petitioner, enabling him to work out his remedy in the manner known to law.
