This petition has been filed to condone the delay of 69 days in filing the Civil Miscellaneous Appeal.

2. The contesting respondent, namely, the first respondent is represented through the counsel. The appeal has been filed only questioning the quantum of compensation fixed by the Tribunal.

3. Notice has been dispensed with for respondent Nos.2 and 4. Notice sent to respondent No. 5 has been served and the name of respondent No.5 has been printed in the cause list. Notice sent to respondent No.3 has been returned with an endorsement "Door Lock".

4. Considering the fact that only the quantum of compensation has been challenged, notice to respondent No.3 is dispensed with in this petition.

5. Considering the reasons assigned in the affidavit filed in support of the petition, this petition is allowed and delay is condoned.

6. Registry is directed to number the petition if it is otherwise in order and further directed to print the name of Mr.N.Sudhagar Nagaraj, learned counsel for respondent No.1 at the time of listing the main appeal for admission.
