PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the 2nd respondent to make payment of Rs.5,00,000/- as medical reimbursement by considering the directions of the 1st respondent vide his order in Rs.No.22083/NHIS-3/2021, dated 26.07.2021, within the period stipulated by this Court.

ORDER

The instant writ petition has been filed by a pensioner seeking medical reimbursement for the expenses incurred for medical treatment of his wife. 2.According to the learned Counsel appearing for the writ petitioner, on 26.07.2021, the first respondent has recommended to the second respondent for disbursement of a sum of Rs.5,00,000/-. Since the said amount was not released, the instant writ petition has been filed.

3.On instructions, the learned Standing Counsel appearing for the second respondent submits that on 13.12.2021, the eligible amount of Rs.75,521/- has already been released to the writ petitioner and therefore, no further amount could be released by the second respondent Insurance Company. 4.In view of the fact that the Insurance Company is repudiating the balance claim, the writ petitioner is at liberty to approach the District Level Empowered Committee for reimbursement of the balance amount as per the rules.

5.With the above said observations, this writ petition stands disposed of. No costs.
