PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the records relating to the FIR in Crime No.24/2022 dated 11.10.2022 on the file of Respondent No.1 Polic for an alleged offence u/s. 5(1),5(n),5(j)(ii), 6 of Protection of Child from Sexual Offences Act, 2012 and Section 9 of Prohibition of Child Marriage Act 2006 and quash the same as illegal as far as the Petitioner is concerned. This Criminal Original Petition had been filed to quash the First Information Report in Crime No.24 of 2022 on the file of the first Respondent police.
2. Mr.A.Kalidoss (Enrl No.3159/2018) learned Counsel had filed vakalath on behalf of the second Respondent.
3. When the matter is taken up for hearing, the learned Additional Public Prosecutor had circulated the order of the Hon'ble Supreme Court in the case of K.Dhandapani .vs. The State by the Inspector of Police reported in 2022 LiveLaw (SC) 477, wherein the Hon'ble Supreme Court had issued guidelines.
4. The issue involved in this case is identical.
5. In the light of the reported ruling of the Honourable Supreme Court as referred above, this Criminal Original Petition is allowed and the First Information Report in Crime No.24 of 2022 on the 2/4
file of the first Respondent is hereby quashed. Consequently, connected miscellaneous petition is closed.
