PRAYER : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the 3rd respondent to expedite the petitioner's appeal petition dated 30.03.2023 regarding the cancellation of patta and rectifying the mistake occurred in the FMB in respect of SF No.787/4B, 787/5B corresponding old SF No.102/22A, 102/23 of Ponnamaravathi East Village, Ponnamaravathi Taluk, Pudukkottai District in the light of document bearing No.495/1979 dated 27.11.1979 within stipulated time fixed by this Honble Court. The petitioner, with a grievance on the entries made in the patta, has preferred an appeal before the third respondent under the Tamil Nadu Patta Pass Book Act, in the month of March 2023, but the same has not been disposed of so far. Hence, the present Writ Petition has been filed. 2/5

2. The learned Special Government Pleader appearing for the respondents 1 to 4, on instructions, submits that the respondent No.3 is conducting the enquiry and the appeal preferred by the petitioner would be disposed of within a reasonable time.

3. Considering the fact that the appeal has been preferred by the petitioner in the month of March 2023, this Writ Petition is allowed with a direction to the third respondent to dispose of the appeal preferred by the petitioner as expeditiously as possible preferably within a period of 12 weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
