ORDER

Heard both sides.

2.The petitioner has filed O.S.No.389 of 2024 on the file of the Additional District Court, Palani against her brother and others seeking the relief of declaration and partition. The suit is still pending. The petitioner apprehends that her brother and his wife may part with the suit property. Therefore, the petitioner filed an objection petition before the third respondent. The petitioner wants the third respondent not to entertain any document from her brother as well as her brother's wife till the conclusion of the suit.

3.I am afraid that such a general relief cannot be granted in this writ petition. The petitioner has to necessarily obtain an interim order before the trial Court in the pending suit.

4.The petitioner has filed I.A.No.330 of 2024 in this regard. The trial Court is directed to dispose of the said IA on merits and in accordance with law on or before 31.10.2025. The trial Court is also directed to advance the hearing of IA to an earlier date in the third week of this month itself. Till 31.10.2025, the third respondent shall not register any document that may be presented by the writ petitioner's brother and his wife. The restraint order passed against the registering authority till 31.10.2025 shall not be construed as expression of any opinion of the merits of the writ petitioner's claim. It is further clarified that the restraint order passed by this Court will cease to operate till 31.10.2025. I make it clear that I have not gone into the merits of the matter.

5.This writ petition is disposed of accordingly. No costs. 03.09.2025 NCC : Yes/No Index : Yes / No Internet : Yes/ No ias Issue order copy on 04.09.2025.
