ORDER

This writ petition has been filed for a writ of Mandamus to direct the respondent to return the original document in Document No.41 of 2006 and pro note mortgaged by the petitioner towards the loan in account number. 00290600028950 to the Petitioner based on the representation dated 14.08.2025.

2. The learned counsel for the petitioner and the learned Standing Counsel for the respondent confirms that the dispute between the petitioner and the respondent Bank was settled before the Lok Adalat on 27.03.2023, following the respondent Bank filed O.S.No.66 of 2010 before the Sub Court, Sivagangai. However, it is submitted that since the case was settled before the Lok Adalat on 27.03.2023, the respondent Bank failed to file an application for the return of documents.

3. The learned Standing Counsel for the respondent submits that the respondent Bank will take necessary steps to retrieve the documents from the Court and return back to the petitioner.

Recording the above submission, the writ petition stands disposed of by directing the respondent to take steps to retrieve the documents from the Sub Court, Sivagangai before whom O.S.No.66 of 2010 was filed in respect of dispute settled before the Lok Adalat on 27.03.2023. This exercise shall be completed within a period of 8 weeks from the date of receipt of a copy of this order. No costs.
