Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the Respondents to conduct proper enquiry as per Section-15 of the Registration of Births and Deaths Act, and to remove the unknown person name of Sabitha Banu from the death Certificate by considering the representation of the petitioner dated 02.08.2025.

Heard both sides.

2. The writ petitioner's son Vel Murugan passed away on 17.07.2025. He was working as Gangman in TANGEDCO. The fourth respondent had obtained the death certificate. The fourth respondent had been referred to as the wife of the deceased Vel Murugan. The petitioner wants the said name to be deleted. According to the petitioner, the fourth respondent is not the legally wedded wife of the deceased / her son. In this regard, the petitioner has already given an application.

3. The RDO, Lalgudi is presently conducting enquiry in the matter. The first respondent is directed to conclude the enquiry and pass a speaking order on merits within a period of six weeks from the date of receipt of the order. The first respondent is obliged to take into account the contentions of the writ petitioner as well as the fourth respondent and duly consider the same while passing the final order. I have not gone into the merits of the matter. The contentions of both sides are left open.
