Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the third respondent to consider the representation of the Petitioner, dated 5.11.2024 based on the first respondent's Na.Ka.No.1666959/2024/Aa4, dated 26.6.2025 positively to enquire after giving opportunity to all sides within the time frame fixed by this Court and to transfer the patta in respect of the property comprised in Old.S.No.768.7B, measuring an extent of 6 cents situated at Nadumandalam Village, Natham Taluk, Dindigul District as per the registered settlement deed bearing No. 622/2006 and issue joint patta of the said property in the name of the Petitioner.

The grievance of the Petitioner is that patta was wrongly isued to the respondents 5 and 6 and that the representation of the Petitioner was not considered and disposed by the second respondent.

2.Learned Special Government Pleader accepts notice on behalf of respondents 1 to 4. Since the request of the Petitioner is for cancellation of patta issued to the respondents 5 and 6, he submits that the Revenue Divisional Officer is the appropriate authority to consider the same.

3.Patta currently stands in the name of respondents 5 and 6. Therefore, no adverse decision should be taken without putting the said respondents on notice and providing them with reasonable opportunity. Since the matter is been disposed of without expressing any opinion on the merits and after directing reasonable opportunity to be granted to the Petitioner and respondents 5 and 6, notice to the said respondents is dispensed with.

4.Accordingly, the third respondent is directed to consider the Petitioner's representation, dated 5.11.2024 and dispose of the same on merits after providing reasonable opportunity to the Petitioner, respondents 5 and 6 and any other person interested in the relevant property. Such representation shall be disposed of within a period of 12 weeks from the date of receipt of a copy of this order.

5.With the above directions, the Writ Petition stands disposed of. No costs.
