PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 4th respondent to approve forthwith the appointment of the petitioner as Drawing Master in the 5th respondent-school from 17.11.2014 onwards with salary and other attendant benefits. ORDER
This writ petition is filed to approve the appointment of the petitioner, from 17.11.2014 onwards, with all attendant benefits.
2. Heard Mr.E.V.N.Siva, learned counsel appearing for the petitioner and Mr.V.Om Prakash, learned Government Advocate appearing for 1 to 4 respondents. Perused the material document available on record.
3. The petitioner was appointed in the 5th respondent school as a Drawing teacher. The petitioner is in possession of certificate issued by the State 2/5
of Kerala. The respondents ought to have considered equivalency before considering for approval of appointment. The school has submitted a proposal to the official respondents and the respondents have not passed any order.
4. Considering the facts stated above, the respondents are directed to consider and pass orders. If the petitioner fulfills all conditions of recruitment, the respondents shall consider the same for approval. The said exercise shall be completed within a period of eight weeks from the date of receipt of a copy of the order.
5. With these directions, this Writ Petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed. Index : Yes / No 12.04.2023 Internet : Yes ksa 3/5
