ORDER : The Court made the following order :- The petitioner, who is apprehending arrest at the hands of the 1/3

respondent police for the offences punishable under section 6(4) of Tamil Nadu Scheduled Commodities (Regulation of Distribution by Card System) order, 1982 r/w section 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.108 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 22.07.2023, at about 01.00 hours, when the respondent police team were on routine check up, they found that the accused persons illegally transported 9700 Kgs of PDS rice using lorry bearing Registration No.TN 07 BT 8767. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. The co-accused has been arrested and later released on bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the earlier anticipatory bail application was dismissed by this Court in Crl.O.P(MD) No.14353 of 2023 considering the huge quantity of PDS rice. Further. the first accused is still absconding and huge quantity of PDS rice was recovered from the petitioner.

5. Considering the conduct of the petitioner and I find no change of circumstance, this Court is not inclined to grant anticipatory bail to the petitioner.
