ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 09.06.2025 for the offences punishable under Section 87 of Bharatiya Nyaya Sanhita (BNS) Act, 2023 and Section 5(1) & 6 of Protection of Child from Sexual Offences (POSCO) Act, 2012, in Crime No.17 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner kidnapped the victim girl and committed sexual assault on her. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 09.06.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the 2/4

petitioner is a married man, he kidnapped the victim girl and sexually assaulted her. Therefore, he opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the nature of offence, this Court is not inclined to grant bail to the petitioner

6. Accordingly, this Criminal Original Petition stands dismissed. (S S Y J) 02.09.2025 jbr 3/4
