Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the First respondent's order G.O.(Ms)No.113, Cooperation, Food and Consumer Protection (CP2) Department dated 29.09.2016, confirming the orders of the second and third respondents dated 04.02.2013 and 20.07.2011 respectively and quash the same and consequently direct the respondents to bring about an amicable settlement of the mutual claims of the members and the society without causing any harassment to the members. O R D E R

When the matter was taken up for hearing, learned Counsel for the petitioner submitted that the petitioner is dead and subsequently, another

member of the Thirumalai Mills Employees Cooperative Thrift and Credit Society, has filed a petition, to substitute him in the place of the petitioner. 2.The fact remains that only the legal representatives of the petitioner are entitled to represent the estate of the petitioner. However, the impleading petitioner is not the legal heir of the petitioner herein and an individual or independent claim cannot be agitated through a Writ Petition in the name of a deceased member.

3.In view of the above, this Writ Petition is dismissed as abated. There shall be no order as to costs. Consequently, the connected miscellaneous petition is also dismissed.
