Respondent / Respondent / Complainant PRAYER :- This criminal original petition is filed under Section 439(i)(b) of Cr.P.C., to modify the condition of Rs.1,00,000/- imposed as against the petitioner in Cr.M.P.No.4589 of 2023 dated 5.9.2023 on the file of the learned Principal District and Sessions Judge, Virudhunagar District at Srivilliputhur in connection with Crime No.303 of 2023 on the file of the 1st respondent police.

ORDER

This Criminal Original Petition has been filed by the petitioner seeking modification of the conditional order, imposed on the petitioner to pay a sum of Rs.1,00,000/- to the District Mediation Centre, Virudhunagar District, vide order dated 14.08.2023 made in Cr.M.P.No.4154 of 2023 on the file of the learned Principal District and Sessions Judge, Virudhunagar District.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent.

3. Earlier the petitioner has moved the learned Principal District and Sessions Judge, Virudhunagar District, Srivilliputhur, seeking modification of the order in Cr.M.P.No.4589 of 2023 and the petition came to be dismissed vide order dated 05.09.2023.

4. The learned Government Advocate (Crl.side) would submit that the total worth of the contraband invoved in this case is Rs.5,000/-.

5. Considering the submissions of the learned Government advocate and considering facts and circumstances of this case, the condition imposed by the learned Principal District and Sessions Judge, Virudhunagar District, vide order dated 14.08.2023 made in Cr.M.P.No.4154 of 2023, is modified to the effect that the petitioner shall pay a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) to 2/4

the credit to the District Mediation Centre, Virudhunagar District.
