ORDER
The petitioner herein seeks a direction to the respondents to consider his representation dated 21.04.2025 and issue patta in his name. 2.Heard the arguments of Mr.FR.S.Savarimuthu, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, he purchased the property situated in Survey No.213, Moolankudi Village, Thirumayam Taluk (currently part of Ponnamaravathi Taluk) Pudukkottai District, under a sale deed dated 27.02.1970. The said property was subdivided and assigned with new
Subdivision Nos.406/1 to 406/12. The subdivision Nos.406/2 to 406/12 have been mutated in favour of the petitioner. However, Subdivision No. 406/1 is wrongly classified as "Anatheenam" in the revenue records. Therefore, the petitioner submitted a representation on 21.04.2025 before the official respondents seeking issuance of patta in respect of Subdivision No.406/1. The same has not been considered. Hence, the petitioner has come before this Court.
4.The learned Additional Government Pleader appearing for the respondents would submit that the competent authority to consider the request of the petitioner is the Commissioner of Land Administration and the petitioner has not submitted any representation before the competent authority.
5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to forward the representation of the petitioner dated 21.04.2025 to the Commissioner of Land Administration, Chennai, within a period of three weeks from the
date of receipt of a copy of this order. The said authority shall consider the same and pass final orders on its own merits within a further period of twelve weeks, after affording reasonable opportunity to the petitioner and other interested parties. Accordingly, this Writ Petition is disposed of. No costs.
