O R D E R

The petitioner has challenged the impugned order passed by the second respondent, dated 30.08.2016, disclosing that the petitioner was not selected to the post of Bugler Constable on the ground that he had secured only 38 marks out of 100.

A counter affidavit has also been filed by the second respondent before this Court and in Paragraph No.4, it has been categorically stated that the petitioner and others appeared before the Selection Committee and participated in the test and that the total marks of the test is 100 and the petitioner secured only 38 marks, whereas the pass mark is 40.

3. According to the second respondent, on account of the same, the petitioner was not eligible for selection to the post of Band Police Constable.

4. Learned counsel appearing for the petitioner also submits that the petitioner did not secure the pass marks for being eligible for selection to the post of Band Police Constable.

5. In view of the same, the petitioner cannot be appointed as Band Constable as claimed in this Writ Petition.

6. Therefore, there is no merit in this Writ Petition and accordingly, the same stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
