PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct the R1 herein to withdraw the complaint of the petitioner dated 11.10.2022 from the file of R2 and to entrust the same to the R3 or to some other agencies for further enquiry within a stipulated time fixed by this Court. 1/4

ORDER

This petition has been filed seeking direction to the R1 herein to withdraw the complaint of the petitioner dated 11.10.2022 from the file of R2 and to entrust the same to the R3 or to some other agencies for further enquiry within a stipulated time fixed by this Court. 2.The enquiry file in C.S.R.No.526 of 2023 is called for and perused. Perusal of enquiry file shows that the counter party namely Ganesan has disputed the undertaking that it was obtained under threat. He has also given undertaking that they will resolve the issue through proper civil process.

3.There is no question of withdrawing the complaint and transferring the same to some other police officer. The petitioner can workout their remedy through appropriate civil process. I find absolutely, no reason to entertain this petition.
