The learned Counsel for the Petitioner submitted that this Criminal Original Petition had been filed to transfer the enquiry on the Petitioner's complaint, dated 16.09.2022 pending on the file of the second Respondent to any other competent officer under the supervision of the first Respondent.

2.As per the reported Ruling of the Division Bench of this Court in the case of CDJ 2018 MHC 5100, in the case of G.Prabakaran vs The Superintendent of Police, Thanjavur District and another, the Petitioner has to exhaust his remedy under Section 156(3) before the Court of the Judicial Magistrate concerned, only then he can approach this Court. Hence, this Criminal Original Petition is dismissed in the light of the report Ruling of the Division Bench of this Court in CDJ 2018 MHC 5100, in the case of G.Prabakaran vs The Superintendent of Police, Thanjavur District and another. 17.11.2022 Index:Yes/No cmr 2/4
